Anti-Spam (CASL) Policy

This Anti-Spam Policy sets out how Data Solutions Technologies complies with Canada’s Anti-Spam Legislation (CASL). The goal of this policy is to ensure that any commercial electronic messages (CEMs) sent by or on behalf of our company — whether from or to systems in Canada — follow a consistent, lawful, and transparent process.

We are committed to preventing spam, protecting recipients’ rights, and maintaining the trust of our clients, partners, and prospective customers.


Scope of Application

This policy applies to all employees, contractors, and authorized representatives of Data Solutions Technologies who may send, manage, or authorize the sending of CEMs that:

  • Originate from a Canadian computer system,
  • Are directed to recipients using Canadian systems or addresses, or
  • Are accessed by recipients located in Canada.

All CEM-related practices must comply with CASL and this Anti-Spam Policy.


Consent Practices

We obtain express, opt-in consent before sending CEMs, unless a valid basis for implied consent exists or where CASL provides an exemption.

Consent must be captured clearly — such as via unchecked opt-in boxes or documented verbal consent. Recipients must be informed of their right to withdraw consent at any time.

Records of express and implied consent are maintained for at least three years after communications have ended.


Form and Content of Messages

All CEMs sent by or on behalf of Data Solutions Technologies must:

  • Clearly identify the sender,
  • Include a valid physical mailing address,
  • Provide a working phone number, email, or website link, and
  • Include an easy-to-use unsubscribe option.

Any third-party vendor sending CEMs for us must follow the same standards.


Managing Relationships & Records

We maintain accurate records to demonstrate CASL compliance, including:

  • Documented express consents,
  • Evidence of implied consent,
  • Unsubscribe and do-not-contact requests.

Commercial Electronic Messages (CEMs)

A CEM is any electronic message that promotes or markets Data Solutions Technologies or its services (email, SMS, social media, etc.).

Internal communications and inquiry responses are exempt if they contain no promotional content.


Unsubscribe Mechanism

Every CEM must offer a simple unsubscribe option.

Requests are processed within 10 business days. Once unsubscribed, contacts are flagged to prevent future non-compliant communication.


Third-Party Compliance

Any third-party partner sending messages on our behalf must comply with CASL, including consent, message format, and unsubscribe handling.


Policy Oversight and Enforcement

This policy is reviewed annually. Changes require leadership approval.

Non-compliance may result in disciplinary action or vendor contract termination.
